Partial Renewal Process

An overview of the partial renewal process.

Process

Per the lease agreement, “if there are multiple Tenants on this Lease, their security deposit is one joint deposit, and occupancy of the Premises is terminated when the last Tenant, or his/her subtenant or assignee, vacates at lease end.”

  • In the case of a al lease of any kind (full or partial) the security deposit shall remain with Baker Street.
  • Tenants moving out at the end of the current lease term (not remaining on the lease) will not receive their portion of the security deposit back. Instead, they are responsible for working out with the incoming tenants transfer of applicable security deposit amounts. Baker Street will not intervene in this process.
  • Incoming tenants being added to the renewal lease assume full responsibility for the condition of the property, which will come as-is when they move in, and any deductions when the lease is terminated. Baker Street will not walk through properties to document condition in between tenants.
  • Baker Street is happy to provide any tenant of the renewal lease with a copy of the move-in condition report for the property if one is available. Baker Street also encourages incoming tenants to view the unit prior to signing the lease if they are concerned about taking on the liability of the condition of the unit. They may arrange viewing the unit directly with the current tenants (Baker Street does not conduct tours for renewal leases).
  • If at the termination of the lease there is a dispute among tenants regarding which tenants are responsible for security deposit deductions, Baker Street will not intervene. We strongly encourage tenants to create an agreement amongst themselves upfront and to document condition together as a way of protecting themselves from roommate disputes regarding responsibility for deductions in the future.
  • At the final termination of the lease, when all tenants have moved out and there are no further renewals, the security deposit (minus any deductions) will be returned to one of the tenants from the most recent al lease and that tenant is responsible for distributing funds to other tenants as applicable.
